Airline Injury Lawsuits

We're you injured during an international flight?  Interestingly, recovery for damages sustained in the course of international air travel is specifically governed by an international treaty: the Montreal Convention.   The Montreal Convention provides for strict liability against the airline under certain circumstances.

Were you injured as a result of an airline “accident”?  Sounds easy enough to answer, right?  Well, this may come as no surprise, but the answer is “No.”  The definition of an “accident” under the Montreal Convention is anything but simple and is frequently the source of debate when a claim is filed.  For U.S. citizens and residents, the definition of an accident is largely governed by Federal case law. 

Hot tea spilling on your lap or a passenger’s swinging luggage may constitute an accident for which you’re entitled to a recovery while being hurt during a rapid descent or by the reclining chair of the passenger in front of you may not.  Again, whether recovery is likely or at all possible frequently depends greatly on whether or not an “accident” occurred.
